Los servidores públicos no siempre actúan en función del interés de la comunidad a pesar de las amenazas y sanciones establecidas en el derecho; es necesario encontrar nuevas vías de actuación para resolver tan importante problema. En ese sentido, este artículo busca fundamentar los principios que deben regir la actuación de los mismos. Para ello, en primer lugar, se intenta establecer un método que permita la creación de estos principios, basándose en la teoría del valor de Luis Villoro y en (...) la ética de Immanuel Kant. Posteriormente, se identifica el interés público como aquel valor que se busca por él mismo sin necesidad de acudir a otros valores para cuyo fin esté dispuesto. A continuación, se derivan los valores de responsabilidad, objetividad, imparcialidad, razonabilidad, publicidad, solidaridad, prudencia e instrumentalidad, a partir de los cuáles se construyen principios éticos que puedan, posteriormente, ser positivizados en el derecho. This essay discusses the ethical challenges and dilemmas in allocating scarce medical resources during the COVID-19 pandemic, using the German legislative process as a starting point. It is guided by the right to non-discrimination of people with disability and generally contrasts utilitarian and rights-based principles of allocation. Three approaches that were suggested in the German discussion, are presented, the lottery principle, the first come first served principle and the probability to survive principle. Arguments in favour and against each principle are (...) discussed. The focus is on the utilitarian probability to survive principle, which was adopted in German legislation in 2022, and its discriminatory potential against people with disability. The essay suggests ways to mitigate the concerns of discrimination related to the probability to survive principle. It concludes that resolving the triage dilemma requires a balanced approach between utilitarian and rights-based concerns, which promotes both maximising the number of patients surviving and the right not to be discriminated against and be treated equally. It calls for a further debate on how many ethical values such as equity, fairness and non-discrimination we are willing to sacrifice for a higher number of survivors and when we are willing to sacrifice survivors to secure ethical values. In this paper, we discuss a proposal for reform in the teaching of Euclidean geometry that reveals the symbiotic relationship between axiomatics and pedagogy. We examine the role of intuition in this kind of reform, as expressed by Mario Pieri, a prominent member of the Schools of Peano and Segre at the University of Turin. We are well aware of the centuries of attention paid to the notion of intuition by mathematicians, mathematics educators, philosophers, psychologists, historians, and others. To set (...) a context for Pieri’s proposal, we only seek to open a small window on views of the pedagogical role of intuition, from primary education to university study that may have informed early 20th century efforts to improve the teaching of geometry at the secondary school level. Pieri addressed the topic of intuition in many of his axiomatizations, including those in projective geometry which was his main area of concentration in foundations. We focus here primarily on his axiom systems for elementary geometry, which embraced the transformational approach of Felix Klein’s vision for the subject. Our goal is to convey Pieri’s thoughts on how to integrate two types of intuition, denoted as sensible and rational, in his endeavors to improve the teaching of the geometry of Euclid. We show how Pieri’s views on geometric intuition and pedagogical reform were either ignored or misrepresented in several notable publications at the turn of the 20th century. In particular, we give Pieri a voice in response to specific comments made in the early 1900s by Federigo Enriques, Ugo Amaldi, and Florian Cajori in widely circulated publications inspired by Klein. The main objective of this work is to examine the prevalence of psychopathy in the general adult population from the main currently existing theoretical perspectives of psychopathy, using for this purpose the five-factor or Big Five model as a common language that allows the comparison and integration of the personality traits considered as defining psychopathy by these different perspectives. The NEO Personality Inventory-Revised was applied to a sample of 682 adults of the general Spanish population. The prevalence of clinical and (...) subclinical psychopathy was calculated according to six different definitions of these two constructs based on Hare’s, Lilienfeld’s, triarchic, and DSM-5-hybrid models, and the simultaneous presence of a minimum number of personality traits that differed from the sample mean by one standard deviation. Prevalence rates for the different definitions were consistently low, indicating that the prevalence of clinical psychopathy in the general Spanish population is around 0.55%, and that of subclinical psychopathy is around 1.65%. There were no significant sex differences in the prevalence of psychopathy. These results question the alarmist claims that warn about the existence in society of a very high number of people with psychopathy who can cause many social, economic, physical, and psychological damage to others. The nurse-patient relationship involves complex attitudes and behaviours with ethical and deontological implications. It has been linked to improvements in patient health outcomes, although there is still no consensus in the scientific literature as to the definition and characterisation of the concept. This article aim to define the concept of the nurse-patient relationship. A concept analysis was conducted using the Walker and Avant method to identify the attributes defining the nurse-patient relationship. An integrative review of the literature was conducted using (...) the PubMed, Web of Science, Scopus, and Cumulative Index to Nursing & Allied Health Literature databases. A review of the grey literature and other minor non-indexed publications on the topic was also conducted. A total of 36 articles were included in the review. A model case, a contrary case, a related case, and empirical references were produced to clarify the concept and identify its essential attributes. The concept is defined as a helping relationship involving interaction between different players. It is the basis of nursing care and is intended to meet the healthcare needs of the individual receiving this care. It is also viewed as an intervention in itself, requiring a specific training process just like any other nursing skill. The essential attributes of the relationship are empathy, presence, contact, authenticity, trust, and reciprocity. In conclusion, the nurse-patient relationship is a helping relationship established with the patient and/or their family based on interaction, communication, respect for ethical values, acceptance, and empathy in order to encourage introspection and behavioural change. Key components include communication, active listening, and respect. Bioethical values and confidentiality must also be present to ensure that the relationship is built on equality and intimacy. Music the art of combining sounds, maintains a sequence of time with harmony, melody and rhythm, generates changes in cognitive processes, improves concentration, memory, influences mood, produces changes in emotions, helps control anxiety, increases motivation, and decreases cortisol levels, the stress hormone, activates the hormone of happiness and rest, serotonin and melatonin. The objective was to analyze the influence of music in the purchase process and decision. The approach was qualitative-quantitative, exploratory level, descriptive statistics was applied to identify the main (...) trends and musical genres. The survey was carried out online, in the "La Condamine" market (November-December 2022). The sample 354 customers. The results of the investigation determined that customers enjoy listening to instrumental sounds in the food court, and in the vegetable, fruit and vegetable section; and the musical genre pop and/or reggaeton in the clothing section. The survey data was corroborated with the results of the biometric eyes tracking equipment in eight participants, attention, meditation and blinking were analyzed, with two sounds, sound 1: folk music and sound 2: pop; the average of the evaluations determined the level of acceptance of the participants for the musical genre, confirming the traditional survey with the results of the biometric equipment. Hearing goes beyond what can be perceived with sight and smell; there are sounds and melodies that connect us with emotions (laugh, cry, enjoy) and memories. It is concluded, (i) consider the musical genre according to the segment, (ii) the hours of greatest influx of customers, (iii) areas or sections of the market with greater or lesser product sales, (iv) slow music in places with more expensive products to extend their stay in the establishment. Se realiza la investigación con el objetivo de perfeccionar la obtención del consentimiento informado en las amputaciones mayores de causa vascular en el Servicio de Angiología del Hospital Universitario Manuel Ascunce Domenech. Se constató debilidades en la institucionalización del consentimiento informado y específicamente en el caso de tales amputaciones. Se utilizaron métodos y técnicas del nivel empírico: encuestas a 30 pacientes con riesgo inminente de amputación. El 64% eran mayores de 65 años, 73 % femeninos, todos escolarizados y 73% residentes (...) urbanos. Los resultados más relevantes fueron: que el 54% de los pacientes manifestaron debe existir consentimiento en la aceptación de la amputación, aunque un grupo no despreciable el 37% declinó este derecho a favor de sus familiares. A los médicos se les realizó una entrevista y aunque no hubo unanimidad de criterios, todos coincidieron en que debía legislarse este consentimiento, como parte del perfeccionamiento de los servicios de salud. Research is conducted to improve the process of obtaining informed consent for major amputations due to vascular causes in the Angiology Service of the Manuel Ascunce Domenech Teaching Hospital. Deficiencies were identified in the institutionalization of informed consent protocols, most specifically as they relate to major lower limb amputations. Empirical methods and techniques were used. Thirty patients at imminent risk of amputation were surveyed by questionnaire methods; 64% of those surveyed were of 65 years of age, 73% were female, all of them had an average educational level, and 73% were urban residents. The results indicated that 54% of patients recognized the importance of informed consent in cases of amputation, although a rather considerable group declined this right for their families. Physicians were also interviewed and, although there was no unanimity of criteria, all of them considered that this consent should be legislated as part of the improvement of health services. Child-to-parent violence is a growing public health problem with consequences for perpetrators and families. Most research has focused on individual and family risk factors. However, little is known about its links with individual outcomes. The aim of this study was to analyze the relationships between CPV and psychological distress, suicidal ideation, and self-concept in school-aged adolescents, taking into account the gender perspective. A study was conducted with a sample of 8,115 adolescents, aged between 11 and 16 years from the State (...) of Nuevo León, Mexico. A MANOVA 3 × 2 was performed to analyze the data. The results revealed that adolescents involved in CPV showed higher levels of psychological distress and suicidal ideation and lower levels of family and social self-concept. It was also observed that girls with higher levels of CPV scored the lowest levels of psychological distress and suicidal ideation, as well as the lowest levels of family self-concept. The findings highlight that adolescents and especially girls involved in CPV also report internal maladjustment outcomes. Finally, the results and their implications for research and intervention with adolescents involved in CPV are discussed. (shrink)

Este texto parte de uma tentativa de me encontrar e encontrar outros caminhos metodológicos de pesquisa através de uma escrita-pensante-ensaística-afetiva. Ao entrar em contato com a linguagem ensaística do filme-ensaio Elena (2012) dirigido por Petra Costa, me questionei e questionei o mundo que me cerca. Neste ensaio, apresento o modo como me juntei com as oito mulheres, minhas sujeitas afetivas e, pensamos juntas nas questões do feminino a partir das imagens do referido filme. Aproximei as imagens das minhas sujeitas (...) afetivas em quadros negros e realizei montagens visuais tendo como inspiração o Atlas Mnemosyne de Abby Warburg, dos quais apresento uma delas. Concluímos, que é possível construir outras metodologias para pesquisas com imagens, a partir da conexão do conteúdo visual, dos olhares de mulheres diversas e dos afetos que os envolvem. (shrink)

A macroscope is proposed and tested here for the discovery of the unique argumentative footprint that characterizes how a collective manages differences and pursues disagreement through argument in a polylogue. The macroscope addresses broader analytic problems posed by various conceptualizations of large-scale argument, such as fields, spheres, communities, and institutions. The design incorporates a two-tier methodology for detecting argument patterns of the arguments performed in arguing by an interactive collective that produces views, or topographies, of the ways that issues are (...) generated in the making and defending of standpoints. The design premises for the macroscope build on insights about argument patterns from pragma-dialectical theory by incorporating research and theory on disagreement management and the Argumentum Model of Topics. The design reconceptualizes prototypical and stereotypical argument patterns for characterizing large-scale argumentation. A prototype of the macroscope is tested on data drawn from six threads about oil-drilling and fracking from the subreddit Changemyview. The implementation suggests the efficacy of the macroscope’s design and potential for identifying what communities make controversial and how the disagreement space in a polylogue is managed through stereotypical argument patterns in terms of claims/premises, inferential relations, and presentational devices. A common approach for measuring the effectiveness of an education system or a school is the estimation of the impact that school interventions have on students’ academic performance. However, the latest trends aim to extend the focus beyond students’ acquisition of knowledge and skills, and to consider aspects such as well-being in the academic context. For this reason, the 2015 edition of the international assessment system PISA incorporated a new tool aimed at evaluating the socio-affective variables related to the well-being (...) of students. It is based on a definition focused on the five dimensions proposed in PISA theoretical framework: cognitive, psychological, social, physical and material. The main purpose of this study is to identify the well-being components that significantly affect student academic performance and to estimate the magnitude of school effects on the well-being of students in OECD countries, the school effect being understood as the ability of schools to increase subjective student well-being. To achieve this goal, we analyzed the responses of 234,000 students from thirty-five OECD countries to PISA 2015 questionnaires. Specifically, we considered non-cognitive variables in the questionnaires and student performance in science. The results indicated that the cognitive well-being dimension, composed of enjoyment of science, self-efficacy and instrumental motivation, as well as the test anxiety all had a consistent relationship with student performance across countries. In addition, the school effect, estimated through a two-level hierarchical linear model, in terms of student well-being was systematically low. While the school effect accounted for approximately 25% of the variance in the results for the cognitive dimension, only 5-9% of variance in well-being indicators was attributable to it. This suggests that the influence of school on student welfare is weak, and the effect is similar across countries. The present study contributes to the general discussion currently underway about the definition of well-being and the connection between well-being and achievement. The results highlighted two complementary concerns: there is a clear need to promote socio-emotional education in schools, and it is important to develop a rigorous framework for well-being assessment. This open access book features essays written by philosophers, biologists, ecologists and conservation scientists facing the current biodiversity crisis. Despite increasing communication, accelerating policy and management responses, and notwithstanding improving ecosystem assessment and endangered species knowledge, conserving biodiversity continues to be more a concern than an accomplished task. Why is it so?The overexploitation of natural resources by our species is a frequently recognised factor, while the short-term economic interests of governments and stakeholders typically clash with the burdens that implementing conservation (...) actions imply. But this is not the whole story. This book develops a different perspective on the problem by exploring the conceptual challenges and practical defiance posed by conserving biodiversity, namely: on the one hand, the difficulties in defining what biodiversity is and characterizing that “thing” to which the word ‘biodiversity’ refers to; on the other hand, the reasons why assessing biodiversity and putting in place effective conservation actions is arduous. This paper investigates Negative Concord, arguing that it results from a systematic lexical ambiguity: the items that participate in Negative Concord ("n-words" in Laka's 1990 terminology) are ambiguous between negative polarity items and their genuinely negative counterparts. I try to show that on empirical grounds the proposed account compares favorably with other analyses that shy away from ambiguity. I furthermore suggest that the ambiguity is not implausible conceptually because it can be viewed as reflecting an intermediate stage of the Jespersen (...) Cycle. Negative Concord can be observed in many languages. The data discussed here are taken from Romance, primarily Spanish. (shrink)

The article discusses Karl Popper’s account of Lamarckism. In this article I use Popper’s published and unpublished statements regarding Lamarckism as well as his correspondence with the Australian immunologist Edward Steele and other biologists to examine why Popper was interested in Lamarckism, how his account of Lamarckism can be understood in the context of his philosophy, and what, if any, new context Popper provided for the discussion of this abandoned doctrine. I begin by discussing Popper’s frame of reference regarding Lamarckism, (...) examining how it changed following his involvement with different “transitory groups” of biologists concerned with redefining the boundaries between traditional disciplines. I then discuss Popper’s account of Lamarckism in positioning it in relation to three aspects of his philosophy: his distinction between the principles of induction/instruction and deduction/selection, his distinction between scientific and teleological concepts, and his concept of progress in science. Then, I follow the debate concerning Steele’s Lamarckian experiments with a closer look at Popper’s role and his position in this controversy. I conclude that Popper’s writings provided a new context for the discussion of Lamarckism in the 1970s and 1980s, thus making it “scientifically acceptable” again. I preface this discussion by a brief outline of Steele’s Lamarckian hypothesis and Popper’s comments on Steele’s work. (shrink)

This article provides a conceptual account of causal understanding by connecting current psychological research on time and causality with philosophical debates on the causal asymmetry. I argue that causal relations are viewed as asymmetric because they are understood in temporal terms. I investigate evidence from causal learning and reasoning in both children and adults: causal perception, the temporal priority principle, and the use of temporal cues for causal inference. While this account does not suffice for correct inferences of causal structure, (...) I show it to serve as a preliminary understanding of causal concepts as asymmetric, that later incorporates other types of evidence. This approach supplies causal models with an asymmetric concept of causation that underlies hypotheses about causal structure, as I will illustrate from the framework of the knowledge-based causal induction model. I further argue for an integrating perspective, showing how the understanding of causes as preceding their effects underlies both psychological models and philosophical debates over time and the causal asymmetry, particularly regarding problem cases such as simultaneous causation or backwards causation, and the conceptual connection between causation and action. Some authors have claimed that Hegel's ‘determinate negation’ should be distinguished from ‘logical’ or ‘formal’ negation, that is, from a view of negation as a contradictory forming operator. In contrast, I argue that dialectical determinate negation involves a view of negation as a contradictory forming operator, and can therefore count as formal negation in every respect. However, as it is clear in contemporary glutty semantics of negation, one may distinguish between different accounts of the relationship between negation, contradiction and content. (...) There is a growing trend across North America of women being criminalized for their pregnancy outcomes. Rather than being a series of aberrations resulting from institutional failures, we argue that this trend is part of a colonial strategy of administrative violence aimed at women of color and Native women across Turtle Island. We consider a range of medical and legal practices constituting gender-based administrative violence, and we argue that they are the result of non-accidental and systematic production of population-level harms (...) that cannot be disentangled from the goals of ongoing settler occupation and dispossession of Indigenous lands. While white feminist narratives of gender-based administrative violence in Latin America function to distance the places where such violence occurs from the ‘liberal democratic’ settler nation-states of the U.S. and Canada, we hold that administrative forms of reproductive violence against Latin American women are structurally connected to efforts in the U.S. and Canada to criminalize women of color and Indigenous women for their reproductive outcomes. The purpose of these systemically produced harms is to sustain cultures of gender-based violence in support of settler colonial configurations of power. (shrink)

Ganeri's [2018] discussion of mental time travel and the self focuses on remembering the past, but has less to say with respect to the status of future-oriented mental time travel. This paper aims to disambiguate the relation between prospection and the self from the framework of Ganeri's interpretation of three Buddhist views—by Buddhaghosa, Vasubandhu, and Dignaga. Is the scope of Ganeri's discussion confined to the past, or is there a stronger assumption that future thought always entails self-representation? I argue that (...) if mental time travel towards the past and towards the future are continuous, both past and future thought should be possible independently of self-representation. An assumption of discontinuity however would enable the employment of the self as one of the defining differences between remembering the past and imagining the future. The two options can be further contrasted on the basis of distinct ways of constructing past/future scenarios (field vs. observer perspective), modes of experiencing time (known vs. lived), and the origin of mental time travel (episodic vs. semantic memory). I further assess the compatibility of future-oriented thought with the three Buddhist views on the basis of these coordinates. (shrink)

In our contemporary age, where a combination of individualism and mutual distrust is unhappily common among people and society is “liquid” and disoriented, so-called intermediate units are a precious resource that promotes positive coexistence within organizations and in local communities, too. The present contribution describes an example of such an intermediate unit, the Talent Club, located in a peripheral neighborhood of a metropolitan area in northern Italy. This case study shows the development of positive living and working together in organizations (...) and their transformation in the tool for community development and good coexistence. Qualitative and quantitative data show that the relational aspect is crucial because it promotes authentic exchange among people, supporting participation and social cohesion against self-referential habits and isolation. Gender-based forms of administrative violence, such as reproductive violence, are the result of systems designed to enact population-level harms through the production and forcible imposition of colonial systems of gender. Settler statecraft has long relied on the strategic promotion of sexual and reproductive violence. Patterns of reproductive violence adapt and change to align with the enduring goals and evolving needs of settler colonial occupation, dispossession, and containment. The U.S. Supreme Court’s recent decision to end the constitutional right to abortion in (...) Dobbs v Jackson is but one instance of this larger pattern. We analyze reproductive and obstetric violence and the structural trauma they produce through the lenses of i) historical continuity and ii) the global architectures of neoliberal settler capitalism in order to connect reproductive rights rollbacks in the U.S. with the expansion of reproductive violence across a world connected by colonial globalization. Olympic combat sports are unconventional physical activity strategies to train middle-aged and older people with and without health problems. This systematic review aimed to assess the available body of published peer-reviewed articles related to the effects of Olympic combat sports interventions on health-related quality of life in adults aged 45 and older. The search was carried out in five generic databases until July 2021 and the protocol was registered in PROSPERO. The PRISMA guidelines were followed and the Downs and Black (...) checklist was used to assessed the methodological quality of the studies. After reviewing 1,151 records, only seven studies met the inclusion criteria, adding 212 participants with a mean age of 63.7 years. Six studies provided data to calculate the effect size in the Olympic combat sports groups. Three studies reported beneficial changes with a small ES for the total score of the health-related quality of life. Two studies reported a beneficial change with a small ES and strong ES for physical health. One study reported improvements with a small ES for emotional and functional well-being. In conclusion, interventions based on Olympic combat sports produce beneficial effects with a small and moderate ES on health-related quality of life in male and female aged 45 and older who are healthy participants, participants with Parkinson's disease, and participants with breast cancer.Systematic Review Registration:https://www.crd.york.ac.uk/prospero/, PROSPERO: CRD42021244161. Based on in-depth interviews, this article examines a sample of 48 Canadian women’s feelings about their changed postpartum bodies, their sense of self, and the factors that affect both. Our findings suggest that understanding women’s postpartum feelings requires contextualizing them in the work of infant care and women’s life circumstances, as well as ideologies about mothering and feminine appearance. Motherhood afforded the women in this study a new appreciation of their bodies, and a positive embodied sense of themselves, but only (...) if they felt their bodies performed maternal functions well. Concerns about appearance persisted and became especially salient when women faced the return to paid work. Moreover, varied life circumstances influenced women’s overall feelings about their changed bodies as insecurities were displaced onto women’s body images. (shrink)

This article examines how specific realist and projectivist versions of manipulability theories of causation deal with the problem of objectivity. Does an agent-dependent concept of manipulability imply that conflicting causal claims made by agents with different capacities can come out as true? In defence of the projectivist stance taken by the agency view, I argue that if the agent’s perspective is shown to be uniform across different agents, then the truth-values of causal claims do not vary arbitrarily and, thus, reach (...) a satisfactory level of objectivity. My argument connects Price’s considerations on the situation of deliberation, whose structure, common to all agents, is the same with respect to both decision making and causal claims on a concept inspired by Douglas’s classification of objectivity of thought processes: the perspective of the detached agent. I further argue that, despite his agent-independent concept of intervention, Woodward’s claim of a stronger objectivity standard cannot be achieved, as the relativity of causal concepts to a variable set brings about the issue of the agent’s choice of variables. Consequently, a more permissive objectivity standard applies to both views. (shrink)

The article examines science-policy conversations mediated by social science in attempts to govern, or set up terms for, scientific research. The production of social science research accounts about science faces challenges in the domains of emerging technosciences, such as nano. Constructing notions of success and failure, participants in science actively engage in the interpretation of policy notions, such as the societal relevance of their research. Industrial engagement is one of the prominent themes both in policy renditions of governable science, and (...) in the participants’ attempts to achieve societally relevant research, often oriented into the future. How do we, as researchers, go about collecting, recording, and analyzing such future stories? I examine a series of recent interviews conducted in a number of US universities, and in particular at a university campus on the West Coast of the United States. The research engages participants through interviews, which can be understood as occasions for testing the interpretive flexibility of nano as “good” scientific practice and of what counts as societal relevance, under what circumstances and in view of what kind of audiences. This paper investigates how an introductory philosophy course influences the moral and political development of undergraduate students in a Liberal Arts university in Central Asia. Within a context of rapid changes characteristic of transitional societies—reflected in the organization of higher education—philosophy provides students with the means to reason about moral and political values in a way that overcomes the old ideological tenets as well as contemporary reluctance to theoretical inquiry. Studying philosophy provides a remedy for deficiencies in both secondary and (...) higher education, by improving general reading and reasoning skills, that enable the development of moral reasoning. Furthermore, familiarity with major works of moral and political philosophy can help students comprehend the patterns of social change, as well as surmount the issue of unsatisfactory theoretical foundations for social science. In the decade following hepatitis B vaccine’s 1981 approval, U.S. health officials issued evolving guidelines on who should receive the vaccine: first, gay men, injection drug users, and healthcare workers; later, hepatitis B-positive women’s children; and later still, all newborns. States laws that mandated the vaccine for all children were quietly accepted in the 1990s; in the 2000s, however, popular anti-vaccine sentiment targeted the shot as an emblem of immunization policy excesses. Shifting attitudes toward the vaccine in this period were (...) informed by hepatitis B’s changing popular image, legible in textual and visual representations of the infection from the 1980s through the 1990s. Notably, the outbreak of AIDS, the advent of genetically engineered pharmaceuticals, and a Democratic push for health reform shaped and reshaped hepatitis B’s public image. Hepatitis B thus became, in turn, an AIDS-like scourge; proof of a new era of pharmaceuticals; a threat from which all American children had a right to be protected; and a cancer-causing infection spread by teenage lifestyles. The metamorphosis of the infection’s image was reflected in evolving policy recommendations regarding who should receive the vaccine in the 1980s, and was key to securing broad uptake of the vaccine in the 1990s.
